Notice under The Local Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2012

On 27 January 2026, the County Council intends to hold a meeting of Cabinet where the following item will be considered: Devolution and establishment of Mayoral Combined County Authority.

 

The purpose of the item is:

 

To consider the developments in relation to establishing an MCCA and whether the Council wishes to agree to its creation and enter into the Statutory Instrument.

 

Under the requirements of Regulation 9 of The Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2021, the Council is required to give 28 days’ notice of a key decision identified within the scope of these regulations.

 

It is considered that the item referred to above would be a key decision and for the reasons of urgency set out below, compliance is considered impracticable, and an exception to Regulation 9 is therefore sought under Regulation 10 of the above Regulations. It is considered impracticable to comply with the requirements of The Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2021 because:

 

It is not possible to delay this decision in order to meet the 28 days’ notice on the Forward Plan due to the anticipation of the Sussex and Brighton Combined County Authority Statutory Instrument (SI) being imminently laid before Parliament. For the SI to be laid before Parliament, the constituent authorities must give their consent. The Government’s announcement on 4 December that the mayoral election for Sussex and Brighton Combined County Authority has been delayed from 2026 to 2028, has resulted in material changes to the draft Statutory Instrument. As such to avoid potential delays to the draft SI being laid before Parliament, the decision must be considered by Cabinet at its meeting on 27 January 2026 to ensure proper arrangements are in place in time, should consent be given.

 

Accordingly, a copy of this notice shall be available pursuant to Regulation 5(6) for at least 5 clear days prior to 27 January 2026.
